Decision not to charge Ariz. sheriff isn't the end
PHOENIX (AP) ? The federal abuse-of-power investigation into America's self-proclaimed toughest sheriff may have been closed without criminal charges but Maricopa County Sheriff Joe Arpaio's legal troubles are far from over.
A civil case brought by a small group of Latinos who accuse Arpaio's office of systematically racially profiling is awaiting a verdict from an Arizona-based federal judge.
The U.S. Department of Justice has also sued the sheriff for alleged constitutional violations including racial profiling, retaliating against Arpaio critics, punishing Latino jail inmates with limited English skills for speaking Spanish and failing to adequately investigate a large number of sex-crimes cases. No trial date in that case has been set.
The Justice Department announced late Friday that it would not pursue criminal charges against the sheriff or his office, or against former Maricopa County top prosecutor Andrew Thomas and a top Thomas aide, Lisa Aubuchon, for abuse of power.
Thomas and Aubuchon were disbarred by the state Supreme Court earlier this year after an ethics panel decided they brought criminal charges against two county officials and a judge in December 2009 with the purpose of embarrassing them. The cases were investigated by Arpaio's now-closed anti-public corruption squad.
Thomas was a longtime Arpaio ally.
Authorities were investigating Arpaio for his part in failed public corruption cases against officials who were odds with him. The sheriff brought cases against a judge and two county officials in 2009 and Thomas prosecuted them.
Federal authorities also said Friday that they have decided to not prosecute matters tied to alleged misuse of county credit cards by sheriff's officials, alleged misspending of jail-enhancement funds and other matters.
The yearslong probe by the FBI and federal prosecutors into Arpaio, Thomas and their offices began during the tenure of President George W. Bush, although Arpaio, a fellow Republican, has since called it politically motivated since.
"If I did something wrong there would be indictments floating all over the place," Arpaio said at a news conference called late Friday night. "I'm not going to get into all the details whether it's political, a witchhunt or whatever you have. The bottom line is we were cleared and we should stay with that and not get into all the politics involved."
Arpaio critics reacted with dismay to the decision not to seek criminal charges, saying they had hoped the Justice Department would finally act against what they call an out-of-control sheriff's office.
"It's an understandable reaction," said Paul Charlton, a former U.S. attorney in Arizona who has worked for one of the county supervisors who was charged. "I can see how after so many years and so much misconduct by Joe Arpaio you would have that feeling.
Charlton said prosecutors had to measure the likelihood of proving any criminal case beyond a reasonable doubt.
"You have to have a reasonable likelihood of success and I trust they made this decision based upon the facts and the law."
But the sheriff will have a different challenge in the civil cases he now faces.
"As a practical and a legal matter it means nothing," Charlton said of the decision not to pursue criminal cases. "This is a different venue and a different standard of proof. It is one that many of Joe Arpaio's critics, including myself, would have liked to have seen come out differently.
"But the end of Joe Arpaio's legal troubles is a long, long way away. He already has lost many legal fights. He has been found to have committed significant misconduct, not the least of which was the finding in the state bar proceeding regarding Andrew Thomas. And I think we will see more of those findings in the future."
Arpaio, 80, is seeking re-election to a sixth term in November. He has a multi-million dollar campaign account on hand to repel two challengers seeking his seat.

World's longest bus can carry 256 passengers

At more than 100-feet end-to-end, a bus capable carrying 256 passengers and driving nearly 5 miles in all-electric mode is the world?s longest bus.
The people mover was developed to ?bridge the gap between conventional city buses and [street cars], offering new possibilities for an environmental friendly public transport,? the German research institute Fraunhofer IVI noted in a news release.?
Potential clients include burgeoning cities in Asia and South America where rail transport is unrealistic due to cost, space, or time restrictions.
The AutoTram Extra Grand, as the three-segmented bus is called, has a multi-axle steering system, which allows it to be maneuvered like a standard 39-foot bus, the university said.?

Brett Anderson, SP, Oakland Athletics

So, yeah, when I said last week that you should be "expecting some stumbles the rest of the way" ... that's a bit tempered now. Anderson's stuff has looked crisp in his first two starts after his completed rehab from Tommy John surgery. He's walked only two so far.
He gets a sometimes-dangerous Boston Red Sox lineup Saturday but could make visits to pitcher-friendly Safeco Field and Angel Stadium after that. When he's active, he's elite. No reason to move away from that down the stretch.
Pedro Ciriaco, 2B/3B/SS, Boston Red Sox
- Last 12: .373 BA, 9 R, 1 HR, 4 RBI, 3 SB in 52 PA
To be fair, at 26, Ciriaco could still be on his way toward finding his power niche, and he can knock for extra bases. But for someone who doesn't leave the yard much, Ciriaco doesn't make much contact (74.8 percent connection rate, 13.0 percent swinging strikes this season) or boast attractive plate discipline (1.9 walk rate) to offer evidence he'll sustain this.
He's been super-aggressive at attacking strike-zone offerings and puts the ball on the ground (51.3 percent) or a rope (27.4) often enough to keep up high BABIPs. But the .405 he's logged this year? Lofty. Like, Jeff Spicoli-riding-a-10-foot-wave lofty, brah.
What Ciriaco lacks in plate awareness, though, he makes up for in his place, in many games, atop a still-effective lineup that's willing to test him the rest of the way given Boston's injuries and overhauls. He'll chip in a few thefts, too, and his eligible positions make him worth carrying, even if he cools, in deep formats.
Kyle Kendrick, SP, Philadelphia Phillies
- Last 4: 4 W, 1.23 ERA, 0.75 WHIP, 22 K in 29 1/3 IP
His opponents in that stretch: at Miami Marlins, at Milwaukee Brewers, vs. Washington Nationals, vs. New York Mets - a mostly favorable stretch. That's not to say Kendrick hasn't grown as a hurler. The righty, who turned 28 this past week, has refined his sinker, induced a career-high 8.3 swinging-strike percentage and pushed his K/9 up to 6.45. It was 4.63 last season. The control, while a bit worse than usual at 2.94 BB/9, is still good enough to back up his work.
He's still safer as a matchup play than a cemented arm, but there are faint signs he's moving closer to the latter for this year and beyond.
Mitch Moreland, 1B/OF, Texas Rangers
- Last 27: .341 BA, 12 R, 5 HR, 20 RBI in 177 PA
The useful plug-in mixed piece has nearly matched his homer total from last year (16 in 464 at-bats in 2011, 15 in 247 this year). His platoon employment has been even more dramatic, and it's aided his output if not his AB total. The natural progression of Moreland, who turns 27 next week, has added more boom, as well.
After a hamstring cost him more than a month of action, he's finding his groove. Normally a play versus right-handers and in Arlington, he deserves more confidence for weekly lineups regardless of destination.
Pedro Alvarez, 3B, Pittsburgh Pirates
- Last 13: .404 BA, 9 R, 5 HR, 10 RBI in 57 PA
The up-and-down masher is once again heading toward his apex. Three of those homers have come in his last two games. He started spraying pitches to all field sectors this summer but soon enough landed in another prototypical slump. At least his power kept coming in bunches during his down time.
Fantasy pickers have re-embraced him during his latest run. He's still a hacker, but he's taking advantage of fastballs more frequently (sticking with his strengths, after all) while showing hints of maturity. The lefty's clips to center (.384) and left (.431) back that up.
He's constantly at risk of violent swings between putting your team on his shoulders and leaving you to shoulder him on the bench. The potential the former holds is enough to take the chance he keeps this up on your squad, not one of your competitors'.
Two new closers and a few rediscovered bats await....

Commentary: The risky business of valuing IP
COMMENTARY | According to widely circulated news reports, the jurors in Apple v. Samsung ignored the testifying experts and calculated damages on their own. Who can blame them? Apple's expert came up with upwards of $2.5 billion as fair compensation for the infringement. Samsung was seeking $500 million in a countersuit. A $3 billion spread makes it hard to trust either analysis.
Valuing intellectual property is risky business, especially when the stakes are high. Investors, regulators, and tax authorities all want to know what a company's technology is worth. If the company doesn't give a straight answer, it risks costly inquiries and investor skepticism.
Unfortunately, a straight answer is hard to come by. Companies have to value IP for all sorts of reasons. And they have to follow different rules, depending on the purpose of the valuation. What if Apple licenses one of its patents to a foreign subsidiary? What if Samsung buys a company with a patent portfolio equivalent to Apple's? Each of those analyses will likely propose a different value for the technology. And chances are slim that either of those values will bear any resemblance to the numbers exchanged last week.
The rules of the road in IP valuation change according to who's driving. If tax authorities are behind the wheel, only a portion of a company's patents may have any value at all. In M&A, financial regulations tend to steer many companies towards high IP valuations. And, while courts typically rely on lost profits and/or reasonable royalty estimates to approximate patent value, juries may well veer off that road and go four-wheeling instead. Small wonder that valuations of the same IP could differ substantially, depending on the analysis. By billions, say.
Tech companies may be thrill-seekers with respect to innovation, but they're pretty conservative when it comes to stuff like financial reporting, tax returns and investor confidence. These audiences don't appreciate miscalculations or uncertainty. Consequently, IP valuation projects must be carefully managed, whatever their purpose. And, even if a company coordinates its multiple IP analyses and carefully controls dissemination of results, it still runs the risk of defending them against a jury's opinion.
If the blockbuster jury award in Apple v. Samsung survives appeal, it could be a game-changer. Technology companies may think twice about risking patent infringement suits. And a decision to steer clear of the courts may require a new approach to innovation. Specifically:
- "I'll show you mine if?" Tech companies may find it more prudent to cross-license technology to entwine their interests and avoid costly litigation.
- "If you can't beat 'em, buy 'em." Less successful innovators may snap up their more creative competitors to access the technology they need. While acquisitions are expensive, they avoid high profile lawsuits and brand-damaging jury verdicts.
- "Since I can't steal your tech, I'll steal your talent." The talent flow between companies may accelerate as competitors lure each other's best and brightest. Companies may find this strategy a relatively cost-effective way to jump-start innovation and cultivate a robust IP portfolio. Even if employers fight back, the stakes shouldn't be as high as they are in patent suits.
Each of the strategies suggested above represents a more conservative approach to IP portfolio enhancement and would result in more cross-licensing, increased M&A activity, and elevated technology salaries. R&D departments may coordinate more closely with finance groups in this environment as companies greet internally generated innovation with more caution.
Intellectual property portfolios represent the crown jewels of successful technology firms. Protecting them is a matter of corporate survival. Unfortunately, assessing their value is a matter of perspective. Litigation introduces yet another perspective, one that may or may not rely on accepted valuation methodologies.
The Apple v. Samsung case may encourage tech firms to take courts out of the valuation equation altogether, by finding new - litigation-resistant - ways to access intellectual property.

NEW YORK (AP) ? The New York City medical examiner's office has ruled the death of hip-hop mogul Chris Lighty a suicide.
The 44-year-old manager of Mariah Carey, Sean "Diddy" Combs and 50 Cent was found dead in his Bronx apartment Thursday with a gunshot wound to the head. A 9 mm handgun was found in the apartment.
The medical examiner's office said Friday that Lighty died from a self-inflicted wound.
Lighty had been a major player in the industry for decades, working with pioneers like LL Cool J before starting his own management company, Violator.
Lighty and his wife, Veronica, had been in the process of divorcing and he was also having financial trouble, according to court records.
